This Privacy Policy discloses the privacy practices for the Website as well as Claw Culture and its affiliated companies and their related sub-domains, sites, services and tools, or any successor site (jointly or severally referred as “Website” or “Services”, as the context so requires). This Privacy Policy (the “Privacy Policy”) describes the ways in which we collect, store, use and protect the information collected due to your use of the Website. By providing us with your information you expressly consent to us processing your personal information in accordance with the terms of the Privacy Policy.

1. CHANGE IN THE PRIVACY POLICY

Changes in law or changes in Claw Culture’s business may require changes to be made to the terms of this Privacy Policy from time to time so Claw Culture encourages you to review this Privacy Policy periodically for any such changes. It is your responsibility to carefully read, agree with the Privacy Policy on each occasion you use the Website and your continued use of the Website shall signify your acceptance to be bound by the latest Privacy Policy.

The Information we collect about you may be broadly described in the following categories:

Personal Information: Your name, address, phone number, email address, feedback, IP address and location, digital device name, type and configuration, details relating to your use of the Service (including the time of access, any interruptions, and the success or failure of transactions), the URL from which you accessed the Website, demographic information, and other such ‘Personal Information’. We do not sell, trade, or rent your personal identification information to others.

We may collect the following information when you share your details with us either through the Website, Net Promoter Score (NPS), card registration, top-up, redemption, exchange, party bookings, birthday celebrations, field trips or any other contact form: Name; Contact information — email address, telephone numbers; Your message in a text-area; and any other information you choose to share.

  1. General Information: We also receive more general information from you as a result of your visits to, and use of, the Website. This general information does not identify you personally, and can include information such as your IP address, the length of time you spend on the Website, your browsing history, cookies and other such ‘General Information’ which is made available.

2. TREATMENT OF PERSONAL INFORMATION

  1. When you use the Website, visit our stores, provide an OTP during a recharge or any transaction, or send emails or other data, information, or communication to us, you acknowledge and agree that you are communicating with us through electronic records. You consent to receive communications from us via such electronic records periodically, as well as when required. By registering your phone number with us, you expressly consent to being contacted by us and/or Landmark group brands via WhatsApp messages, SMS notifications, RCS (Rich Communication Services), email, and/or other approved digital or telecommunication platforms.
  2. Claw Culture collects your Personal Information to enable us, amongst other things, to provide the Website and our Services to you. We take all steps reasonably necessary to protect against the unauthorized access, use, alteration, disclosure or destruction of Personal Information. If Claw Culture is sold to a third party, or Claw Culture otherwise becomes subject to a merger, consolidation or acquisition, it would become necessary for us to transfer your Personal Information to a third party, and in such case Claw Culture would require that the third party handles your Personal Information with no less care than taken by us.
  3. The email address you provide for card registration or any transaction will only be used to send you information and updates related to your transaction. It may also be used to respond to your inquiries and requests. If you decide to opt-in to our mailing list, you’ll receive emails that may include company news, updates, related product or service information, etc. You can unsubscribe from our email list at any time by following the instructions included at the bottom of each email, or by contacting us via our Website.
  4. Other than as may be required in order to operate the Services, or as otherwise described in the Website Terms and Conditions or these Terms, we disclose your Personal Information to third parties only as reasonably required to protect the rights and safety of ourselves and Website users or as required by law enforcement authorities.
  5. Claw Culture may use other companies and/or individuals to perform functions on its behalf (e.g. processing payments, providing customer service, domestic or international data hosting/storage services on cloud or otherwise, operating the Card management and game-reader platform via our technology partner Semnox Solutions / Parafait), and in such circumstances these companies or individuals will be provided access to only such Personal Information required to fulfil their functions (and only on the agreement that they do not use your Personal Information for any other purposes). For all such third-party Websites, you will be bound by the terms, conditions and privacy policy of such third-party Websites for the respective services. You hereby indemnify and hold Claw Culture harmless from all claims, damages, disputes which may arise with or from such third-party Websites or services. Claw Culture shall not be held responsible or liable for any acts or omissions of such third-party Websites or services.
  6. Purposes intended to deliver Services to you, verify your registration information, verify access to your Card and balance of Games and Wins, determine whether you meet the minimum requirements for use of the Service, provide you tailored content and instructions, targeted promotions, provide customer support, and seek your input regarding Claw Culture and the Website.
  7. To keep your Personal Information safe, we ensure that sensitive and private data exchanges between you and the Website happen over a Secure Sockets Layer (SSL)-secured communication channel and are encrypted and protected with digital signatures. SSL-secured communication channels are specially designed to protect personal and sensitive information (payment details), which is sent over the internet.

Apart from aforesaid, we may use third-party service providers to help us operate our business, the Website, or administer activities on our behalf, such as sending out notifications, newsletters or surveys. Citymax Hotels (India) Private Limited, a company registered under the Companies Act, 1956 and having its registered office at 1st Floor, 77° Town Centre, Building No.3, West Wing, Off HAL Airport Road, Yemlur P.O., Bangalore – 560 037 (referred to herein as “Claw Culture”, “CC”, “we”, “our” or “us”) operates the Claw Culture brand of claw machine entertainment outlets across India, and the related Website www.clawculture.in (or any successor site) along with its related sub-domains, sites, Services, and tools (“Website” and/or “Services”). The Website is provided as a service to you and is intended to allow you and other users to browse information about Claw Culture outlets, the Claw Culture Card and related Services (“Services”). Purchase and recharge of the Claw Culture Card, game play, exchange and redemption are available offline, at Claw Culture outlets only. Claw Culture reserves the right to delete, modify, or supplement the content of the Website at any time for any reason without prior notification, and will use reasonable efforts to include up-to-date and accurate information on the Website. NOTWITHSTANDING ANY ORAL OR WRITTEN INFORMATION, OPINIONS, EVALUATIONS, DESCRIPTIONS OR CONSULTATIONS OF ANY KIND FURNISHED BY CLAW CULTURE TO THE CONTRARY, YOU SPECIFICALLY AGREE TO THE TERMS SET FORTH BELOW:

  1. These Terms of Use (the “Terms”) are between Claw Culture and you as an end user of Claw Culture’s Website. Changes in law or changes in Claw Culture’s business may require changes to be made to the Terms from time to time (“Revised Terms”), so Claw Culture encourages you to review the Terms periodically for any such changes. It is your responsibility to carefully read, agree with and accept the Terms and the Website’s Privacy Policy (the “Privacy Policy”) on each occasion you use the Website and your continued use of the Website shall signify your acceptance to be bound by the latest Terms. If you do not agree to (or cannot comply with) any of the Terms, do not use this Website.

2. USER CONDUCT AND CONTENT

  1. You agree to comply with all legal requirements of the applicable jurisdiction(s) with regard to your use of the Website, and you acknowledge that you are entirely responsible for ensuring your own familiarity with such requirements and your own compliance with the same.
  2. The Website may at times provide opportunities for users to post reviews and other comments, questions, suggestions or other information (“User Content”) on or through this Website by e-mail or telephone, or otherwise disclosed, submitted or offered in connection with your use of this Website. You warrant that any such User Content submitted by you to the Website is original (and does not infringe the intellectual property rights of others), and you hereby grant Claw Culture a perpetual, irrevocable, non-exclusive, royalty-free, transferable right and licence to use such User Content however Claw Culture desires, including without limitation, to copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such User Content and/or incorporate such User Content into any form, medium or technology throughout the world, without any further recourse to you, and you hereby waive any moral rights in such User Content. You agree that you will not post any content that is contrary to morality, derogatory, illegal, libellous, defamatory, inflammatory, that infringes intellectual property rights, or that may otherwise breach common decency or be contrary to applicable law.
  3. Claw Culture will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any User Content you submit for any purpose whatsoever, without restriction and without compensating you in any way. Claw Culture is and shall be under no obligation (1) to maintain any User Content in confidence; (2) to pay to user any compensation for any User Content; or (3) to respond to any User Content.
  4. You agree that any User Content submitted by you to the Website will not violate the Terms or any right of any third party, including without limitation, copyright, trademark, privacy or other personal or proprietary rights, and will not cause injury to any person or entity. You further agree that no User Content submitted by you to the Website will be or contain libellous or otherwise unlawful, threatening, abusive or obscene material, or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of “spam”.
  5. Claw Culture does not regularly review posted User Content but does reserve the right (but not the obligation) to monitor and edit or remove any User Content submitted to the Website. You grant Claw Culture the right to use the name that you submit in connection with any User Content. You agree not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any User Content you submit. You are and shall remain solely responsible for the content of any User Content you make and you agree to indemnify Claw Culture and its affiliates for all claims resulting from any User Content you submit. Claw Culture and its affiliates take no responsibility and assume no liability for any User Content submitted by you or any third party.

3. ELIGIBILITY AND SUPERVISION

  1. Claw Culture is intended for use by persons who are at least 18 years of age. If a person under the age of 18 years plays at a Claw Culture outlet, he or she may do so only under the supervision of a parent or legal guardian, who is fully responsible for his or her use of the Claw Culture Card, the machines and the outlet, including all charges and any liability that he or she may incur. Claw Culture reserves the right to refuse service or cancel transactions at its sole discretion.
  2. You warrant that the information you provide at the time of card registration or any transaction at a Claw Culture outlet is true, accurate, current and complete in all respects, and you agree that such information shall be treated as per the Privacy Policy.
  3. You are responsible for the safekeeping and use of your Claw Culture Card and for all activities that occur using it, subject to the terms of Section 10 below. Claw Culture assumes no liability to any person for any loss or damage which may arise as a result of any failure by you in protecting your Claw Culture Card.

4. SERVICES; TRANSACTIONS, PRICING, AND PAYMENT

  1. The Services shall include:

(i) The purchase and/or recharge of your Claw Culture Card with Games at Claw Culture outlets;

(ii) Claw Culture customer support, enabling you to contact Claw Culture at info@clawculture.in with any queries that you may have in relation to your Card, Games, Wins, redemptions or any other Service.

  1. You agree to pay the full amount payable for any recharge or transaction at the outlet, including any applicable charges. All prices are in Indian National Rupees.
  2. Claw Culture may not accept your transaction if (a) the relevant Service is unavailable; (b) Claw Culture is unable to obtain authorisation for your payment; (c) Claw Culture finds a pricing error; or (d) for any other reason at Claw Culture’s sole discretion. In any of these situations, Claw Culture will inform you that your transaction has not been accepted, will not process your payment and will not be liable to you or any third party by reason of our decision to decline to process a transaction, or unwinding or suspending any transaction after processing has begun.
  3. All credit/debit card payments are subject to validation by the issuer. If the issuer of your card refuses to authorize payment, Claw Culture will cancel your transaction and request an alternative method of payment.
  4. All information provided at the time of registration or payment must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms. By confirming your transaction at the counter, you agree to accept and pay for the Service requested.
  5. Certain transactions may constitute improper use of the Services. Claw Culture reserves the right, at its sole discretion, to refuse or cancel any transaction for any reason. Your Claw Culture Card may also be restricted or terminated for any reason, at Claw Culture’s sole discretion.
  6. In the event that a Service is listed at an incorrect price due to an error in pricing, Claw Culture shall have the right, at its sole discretion, to refuse or cancel any transaction placed for that Service. Claw Culture may, at its discretion, either contact you for instructions or cancel your transaction and notify you of such cancellation.
  7. Claw Culture reserves the right, at its sole discretion, to limit the quantity of Games purchased per person or per transaction.

5. PRIVACY

In the course of your use of the Website, we will collect certain information from you (the “Information”) which will be dealt in accordance with the Privacy Policy. Please go through the Privacy Policy available on the Website.

6. DISCLAIMER OF WARRANTIES

  1. To the fullest extent permissible by law, Claw Culture does not warrant that the Website or any of the Services available through it will be uninterrupted or free from errors. There may be delays, omissions, interruptions, and inaccuracies in materials or Services available through the Website or that the Services will meet any particular criteria of performance or quality.
  2. Claw Culture makes no representation or warranties about the accuracy, completeness, timeliness, reliability or non-infringement of any content on the Website or Services available through it.
  3. Although Claw Culture intends to take reasonable steps to prevent the introduction of viruses, worms or other malicious code to the Website, Claw Culture does not represent or warrant that the Website, or Services, features or materials that may be available through the Website, are free from such destructive features. Claw Culture is not liable for any damages or harm attributable to such features.
  4. Electronic transmissions of data including the Internet are public media and any use of such media is public, not private. Information related to or arising from such use is either public or the property of those collecting the information and not personal or private information. Claw Culture does not warrant and cannot ensure the security or confidentiality of any information you transmit to the Website. YOU HEREBY RELEASE US FROM ANY AND ALL OBLIGATIONS, LIABILITIES AND CLAIMS IN EXCESS OF THIS LIMITATION.

These Terms constitute the entire agreement between you and Claw Culture with respect to the subject matter hereof and supersede any previous oral or written arrangements or understandings relating thereto; may not be amended, terminated or waived orally; and may not be assigned or resold, in whole or in part, directly or indirectly, by operation of law or otherwise, by you.

Claw Culture shall not be held liable for any delay or failure in performance of any part of these Terms from any cause beyond our control and without our fault or negligence, such as acts of God, acts of civil or military authority, current laws and regulations and changes thereto, embargoes, epidemics, war, terrorist acts, riots, insurrections, fires, explosions, earthquakes, nuclear accidents, floods, strikes, power blackouts, volcanic action, political unrest, other major environmental disturbances, unusually severe weather conditions, acts of hackers and other illegal activities of third parties, inability to secure products or Services of other persons or transportation facilities, or acts or omissions of transportation or telecommunications common carriers or acts, omissions, overloading or slowdowns over the Internet or any third party Internet service providers.

10. CLAW CULTURE CARD

  • The Claw Culture Card is an RFID-based game card that can be loaded with “Games” (credits to play claw machines) and “Wins” (points earned by exchanging a won toy at the exchange counter, redeemable for larger merchandise).
  • The Claw Culture Card cannot be exchanged for cash.
  • INR 50 will be charged for card replacement in case of loss, theft or damage. Claw Culture may, at its sole discretion and on reasonable verification, transfer the remaining balance of Games and Wins to a replacement card. Claw Culture is not liable for any usage that occurs before a loss is reported.
  • Claw Culture is not responsible for lost, stolen or damaged cards.
  • The Claw Culture Card and the Games / Wins loaded on it can be used only at Claw Culture outlets in India. Card roaming is restricted to Claw Culture stores only and the Card cannot be used at any non-Claw Culture location.
  • The Claw Culture Card can be purchased and recharged only at Claw Culture outlets. Online recharge is not available.
  • By purchasing or using the Claw Culture Card, the customer agrees to abide by all safety rules, regulations and operating instructions applicable at our outlets and machines, and to use the machines only in the intended manner. Tampering with, striking, tilting, prying, reaching into or otherwise interfering with any claw machine is strictly prohibited and may result in forfeiture of Games / Wins, removal from the outlet and, where applicable, legal action.
  • The Claw Culture Card is intended for persons aged 18 years and above. If children play at a Claw Culture outlet, they must be supervised by a parent or legal guardian at all times.
  • Games and Wins loaded onto the Card will be valid for 6 (six) months from the date of last use or last transaction on the Card (whichever is later), including loading, top-up, game play, exchange or redemption. Each fresh transaction resets the validity for a further 6 months from the date of that transaction. Any unused balance remaining after the validity period shall automatically lapse and stand forfeited, and no refund, cash equivalent or carry-over shall be granted in respect of such lapsed balance.
  • All claw games are skill-based amusement activities. Outcomes depend on the customer’s control of the claw within the machine’s mechanical limits. Claw Culture does not guarantee that any particular play will result in winning a toy.
  • If a customer wins a plush toy, the customer may either (a) take the toy home directly; or (b) return the toy at the exchange counter to convert it into Wins on the Card. Wins can be used to exchange toys, gadgets and other collectibles at the exchange counter, and each category of prize is assigned a certain Win value, as determined by Claw Culture and displayed at the exchange counter. Accumulated Wins may be redeemed at any time, including the same day, subject to sufficient balance and stock availability. Once a toy is redeemed and handed over, it cannot be returned or reconverted to Wins, except in the case of a manufacturing defect identified at the time of handover.
